Welcome to 3Shul Motors (“Company”, “we”, “our”, “us”)!

These Terms and Conditions (“Terms”, “Terms of Service”, “Terms of Product”, “Terms of Usage”) govern your activities on our website with domain “3shulmotors.com” (collectively or individually referred to as the “Service”) operated by 3Shul Motors.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information resulting from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). By accessing or using the Service, you acknowledge that you have read, understood and agreed to be bound by these Agreements.

2. Use of Products

By using and/or purchasing our products, you agree to abide by our terms. While we maintain a commitment to quality and attention to detail in the design and manufacture of our products, it’s essential to recognize that our products are intended for high-power electronics, which inherently carry risks.

We urge you to exercise extreme caution in handling and operating our controllers. 3Shul Motors assumes no liability for personal injury, property damage or consequential losses resulting from the proper or improper use of our products.

Please consult the manual before use and ensure the use of appropriate safety equipment when handling high-power electronics. Our products are not intended or manufactured for manned applications unless explicitly specified. For further information, please contact 3Shul Motors at support@3shulmotors.com.

3. Rules & Regulations

The use and operation of radio equipment, such as UHF systems or video transmission equipment may require a license in India and many other countries, with some nations prohibiting their use entirely.

It is your responsibility to ensure compliance with your government’s rules and regulations for RF devices when using products purchased from 3Shul Motors.

We cannot be held responsible for any actions, including the use of products purchased from us in violation of government regulations.

4. Communications

By using our Service, you agree to receive newsletters, marketing or promotional materials, and other information that we may send.

However, you may opt out of receiving these communications by following the unsubscribe link or by contacting us at support@3shulmotors.com.

5. Purchases

When making a purchase through our Service, you may be required to provide certain information relevant to your transaction, including payment details. You represent and warrant that the information you provide is accurate, complete and current.

We reserve the right to refuse or cancel orders, as well as to terminate accounts, for various reasons, including but not limited to product availability, errors in pricing or descriptions, or suspected fraudulent activity.

The Minimum Shipping we charge is $25 per KG.

6. Contests, Sweepstakes and Promotions

Any contests, sweepstakes, or other promotions offered through the Service are subject to separate rules. Participants should review the applicable rules and our Privacy Policy. In the event of any conflict between the Promotion rules and these Terms of Service, the Promotion rules will prevail.

Content on this Service is either the property of 3Shul Motors or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy or use said Content, whether in whole or in part, for commercial purposes or personal gain, without our express advance written permission.

You agree not to use Service which including but not exhaustive:

To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.

Additionally, you agree not to:

Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service.

Take any action that may damage or falsify Company ratings.
Otherwise attempt to interfere with the proper working of Service.

We may use third-party Service Providers to monitor and analyze the use of our Service.

10. No Use By Minors

The Service is intended for individuals at least eighteen (18) years old. By accessing or using the Service, you warrant and represent that you are at least eighteen (18) years of age. If you are under eighteen (18) years old, you are prohibited from accessing or using the Service.

11. Accounts

When creating an account, you must provide accurate and complete information and maintain the confidentiality of your account credentials. You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use or security breaches.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

The Service and its original content are the exclusive property of 3Shul Motors and its licensors, protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

By Purchasing our product you give us permission to use your social media posts, reels & videos to be used by us for marketing and promotions. only the content which have our controller or any other 3shul product in it.

13. Copyright Policy

We respect the intellectual property rights of others and respond to claims of copyright infringement promptly. If you believe that any Content on the Service infringes your copyright, please contact our Copyright Agent at support@3shulmotors.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

14. DMCA Notice and Procedure for Copyright Infringement Claims

You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing:

We welcome feedback and suggestions concerning our Service either directly at support@3shulmotors.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). By providing feedback, you grant us the right to use and commercialize it without any obligation of confidentiality.

17. Warranty Policy

In simpler terms, all controllers purchased from 3shul Motors come with a 3-month warranty. To be eligible for this warranty, you must register your controller within 7 days of receiving your order on the official 3shul Motors website warranty registration portal. This warranty covers replacements for faulty controllers if you meet the following conditions:

You must upload a valid invoice, documents, and any relevant media (such as photos or videos) on the warranty claim portal.
We provide 3 Months Replacement policy only on factory defects, user mistakes are not covered under Replacement warranty.
The product must be registered for warranty on the 3shulmotors.com website’s warranty registration tab.
Be aware that the warranty claim process may take up to 2 weeks while they assess your case.

18. Warranty Disclaimer

Any product modification voids the warranty of the purchase. We reserve the right to change or update the warranty terms and conditions at any time without notice.

This warranty does not cover defects caused by:

Normal wear and tear
Using any other harness which is not recommended by us. (Only 3Shul harness is Recommended)
Misuse, neglect or improper installation of the Products (excluding defects identified through Distributor’s quality control measures implemented).
Use of the Products in an application for which they are not intended.
Product has not been registered for warranty on the warranty registration portal on 3shulmotors.com.
Proper invoice document has not uploaded on the warranty registration portal.
Proper photos of controller has not submitted by customer at support@3shulmotors.com.
Breaking the product’s seal (opening the case or cover) or using it without the case/cover will void the warranty.
Act of God or any other event beyond our reasonable control.
Water inflow in case of non-water proof products.
Our Accessories are tested before shipping and does not come under 3 months warranty. No warranty is applicable on our Accessories.
In case of Replacement or Repair user has to bear the Shipping charges which is minimum of $70 after that depending on the weight of the product.

19. Refund Policy

The refund can only be given in following cases:

We cannot fulfill the replacement order.
If customer wants to cancel the order, then within 72 hours money will be refunded back to the customer in full.
Refund amount can be less than the original amount due to high currency conversion charge.
Before issue of refund amount, customer has to contact us at support@3shulmotors.com to share the proper details.
The $50 USD payment made to reserve the controller is completely non-refundable

20. Order Cancellation Policy

An order can be cancelled within 24 hours of placing the order for full refund.
If the order is cancelled within 15 days, then full amount cannot be refundable. Currency conversion charges will be deducted. In case of delayed cancellation (within 15 days) of order some amount will be deducted depending on the stage the order is in. If it is ready to ship or under transit no refund will be provided for the same.
Order cancellation after 15 days is not acceptable.
Order can only be cancelled after customer email us with a cancellation request on support@3shulmotors.com with order number.

21. Limitation Of Liability

To the extent permitted by law, we are not liable for any indirect, punitive, special, incidental, or consequential damages arising from the use of the Service.

22. Termination

We may terminate or suspend access to the Service at any time for any reason without notice.

23. Governing Law

These Terms shall be governed by the laws of India.

24. Changes To Service

We reserve the right to withdraw or amend our Service and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

25. Amendments To Terms

We may amend these Terms at any time by posting the revised terms on the Service.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service.

26. Waiver And Severability

Any failure to enforce a provision of these Terms does not constitute a waiver of that provision. If any provision is deemed invalid, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.
